Summary of Changes for Kansas Economic and Employment Services Manual (KEESM) Revision No. 80 effective March 1, 2017

Protected Filing Date for SSI:

This revision implements a change in the Protected Filing Date for persons applying for Medicaid on the basis of disability. With this change, a protected filing date for persons who were denied disability based on a determination by the PMDT is only applicable to persons ultimately approved for SSI. Previously, the protected filing date was applicable to both SSI and SSD determinations. A protected filing date is not provided for persons approved only for Social Security disability and a denial of disability provided by PMDT is considered final for these individuals. For persons initially denied disability by PMDT, changes reported within the application period of 90 days (and any appropriate IROD period) may be considered and the application may be reconsidered.

All applications that are currently held in a pending status where a PMDT non-allowance of disability has already been provided will be denied. However, the application may be reopened if the individual is ultimately approved for SSI. The SSI approval must be based on the SSA application associated with the PMDT determination. For MediKan purposes, a Tier 2 approval is treated as a Tier 1 denial and recipients may still receive 12 months of MediKan coverage. But in most instances, Medicaid coverage back to the application date is only available if the individual is approved for SSI. If the SSD determination is made prior to the MediKan approval, or 90 days, Medicaid may be available back to the application date. In addition, updates to the PMDT process have also been included. This is implemented per CMS directive and 42 CFR 435.912 and 42 CFR 435.541( c).

KDHE will issue implementation instructions under separate cover.

KEESM Sections 1413, 2662.3 – 2662.10 are being updated with this revision. Impact of Social Security Determination is being added as item 2662.9, thus moving Protected Filing Dates down to item 2662.10.
