4113 Cash Excluded Members - Certain persons in the mandatory filing unit, however, shall be excluded from the assistance plan because they are not eligible, such as those listed below.
 

  1. SSI recipients (including 1619(b) recipients).

    The individual will be excluded from the benefits and the household size.
     

  1. Persons who are ineligible due to a sanction or other special provisions such as for failure to meet social security number requirements (2130); fraud committed prior to 1/1/12 (11221); time limited assistance (2240); a minor parent under the age of 18 who is unable to act in own behalf fails to cooperate with CSS [2165, 2165 (1), 2165.1 (1) (a) and 2165.1 (2) ]; a minor parent under the age of 18 who is unable to act in his own behalf fails to cooperate with work programs (2230); other program requirements (2182).     The individual will be excluded from the household size.

  1. Persons who are in the custody of the state whose needs are met through foster care payments. Although the person receiving foster care payments is excluded, the person, if in the home, is to remain a part of the mandatory filing unit in which case the person's income and resources would be considered in determining eligibility for others in the plan. Note that foster care payments are exempt per 6410.

    The individual will be excluded from the household size.

  1. Persons who do not meet citizenship and non-citizenship requirements per 2140 or sponsorship provisions.

    The individual will be excluded from the household size.

  1. Persons who are either fugitives from justice by reason of a felony conviction or charge or in violation of a condition of probation or parole imposed under federal or state law. See 2182.

    The individual will be excluded from the household size.


When any of these individuals become eligible to again receive assistance (e.g., fraud penalty ends), the person must be included in the assistance plan. See 7401 (2) or the section pertaining to the eligibility requirement for provisions for adding the person to the plan.
