12800 Incorrect Payments and Fraud

DCF will make every effort to maintain and utilize accurate and current information to ensure benefits are issued in the correct amounts. However, should an  incorrect payment be issued, DCF will evaluate the incorrect payment and act if necessary.

Kansas will only pursue an overpayment and attempt to recover issued benefits in cases where it is reasonable to suspect intent to commit fraud. All cases suspected of fraud will be referred to the fraud unit for investigation. If the fraud unit determines that it is reasonable to pursue a fraud determination DCF will conduct an administrative hearing to determine if fraud occurred and will issue an overpayment on the case to recover the fraudulently-issued benefit(s).

In no instance will the agency reclaim SEBT benefits by reducing a household’s Food Assistance benefit. Kansas will not recover SEBT benefits from Food Assistance benefits already issued.
