Before any person or family may receive USDA commodities for home consumption, it is necessary for eligibility to be determined. USDA requires participating states to develop and maintain an income-based eligibility determination system and establish distribution guidelines for uniform statewide TEFAP implementation. Any person or family receiving cash assistance [Temporary Assistance to Families (TAF), General Assistance (GA) or Refugee Assistance (RE)] or food stamp assistance is automatically eligible to receive TEFAP food for home use (See 2302.3).
Persons and/or households who receive prepared meals through participating Cooperative Emergency Feeding Organizations (soup kitchens) are automatically eligible, without a needs test, for commodities used in the preparation of these meals. However, if individuals receiving prepared meals also wish to receive commodities for home consumption, all factors of household eligibility listed in Section 2000 apply. The only item in Section 2000 applicable to Cooperative Emergency Feeding Organizations (soup kitchens) is Section 2403 which applies to all participating organizations.
The eligibility items listed in this section apply to all needy persons who wish to receive TEFAP commodities for home consumption through Emergency Feeding Organizations (food banks).
Household members must reside in Kansas in order to participate in The Emergency Food Assistance Program (TEFAP) in Kansas. Persons residing in institutions are not eligible for TEFAP participation. Applicants for TEFAP must apply at a participating organiz ation located in the county in which they reside. If no participating organization is located in the county in which the applicant resides, applicants may be unable to participate, may be allowed to apply at a participating organization in another county, or may participate as otherwise indicated in policies established by the Regional Director.
No individual may participate as a member of more than one household or in more than one county in any month. Residency requirements shall not impose any durational requirements nor shall it be construed to mean intent to reside permanently in the state or county.
For TEFAP purposes, a household is a non-institutionalized single individual or a group of related or non-related individuals who are not residents of an institution and who customarily purchase food and prepare meals together for home consumption. Household size is the total number of persons in the applicant/recipient household as defined above.
