2521 Persons Exempt from the ABAWD Provision - The following persons are exempt from the above provision:
This provision applies even if the person under 18 is not receiving food assistance, i.e., considered ineligible household members.
NOTE: Caretaker relative(s) who continue to receive TANF while the child (or children) are temporarily out of the home per 2223, shall not be considered an ABAWD during the temporary status.
A homeless individual is defined as an individual who lacks a regular nighttime residence, which includes:
Supervised shelter designed to provide temporary residence;
Halfway house or similar institution that provides temporary residence;
Temporary accommodation of no more than 90 days in residence of another person; or
Place not designed for regular sleeping accommodations (hallway, bus station, lobby, or other similar places)
An individual who will imminently lose their nighttime residence.
An individual is imminently homeless if they will soon lose their primary nighttime residence and do not have an alternative residence and lack the resources to secure permanent housing. “Soon” is defined as individuals who are within 14 days of losing their housing, do not have another residence, and do not have the resources to secure another residence. Housing includes housing they own, rent, are sharing with others, or are living in without paying rent.
Individuals fleeing or attempting to flee domestic violence, dating violence, sexual assault, or stalking who have no residence other than one shared with or known to the abuser, and inadequate resources to secure housing are experiencing homelessness because they lack a fixed and regular nighttime residence.
