New Employment and Training Requirements for Food Assistance Recipients Effective July 1, 2023

During the 2023 Legislative season, Kansas lawmakers passed legislation increasing the age of mandatory work requirements for abled bodied adults without a dependent in the household. The age increased from 18-49 to 18-59. A letter has been mailed to active Food Assistance households who are between the ages of 50-59 without a child in the home to notify them of this change in policy. Changes to KEES to support this policy will go into the system later this year. More guidance for staff is coming. Below is the language that was sent to impacted households. The letter is expected to appear in Distributed Documents in KEES later next week. We’ll update staff through the Dispatch when the letter is viewable in KEES.

 

Kansas House Bill 2094 amends Kansas law (K.S.A. 2022 Supp. 39-709) pertaining to eligibility requirements for food assistance by increasing the maximum age for mandatory work requirements from 49 to 59 years old. Effective 07/01/2023, able bodied adults ages 18 to 59 years old, without dependents in the household, and who are not exempt under 7 USC § 2015(d)(2) must work or participate in an approved work program for at least 30 hours per week to maintain eligibility for food assistance.

 

Individuals impacted by this new law will receive a separate notice instructing them to participate in a required scheduled meeting to begin participating in the work program. Individuals who do not participate in the program, and who do not have documented good cause for not participating, will no longer be eligible for food assistance in accordance with non-cooperation penalties defined in K.S.A. 39-709.

Disabled Individuals Exempt from ABAWD

REMINDER: The Medical Condition page must be completed if an individual is disabled and exempt from ABAWD work requirements. By entering an appropriate record on the Medical Condition page, KEES will recognize that the person is not an ABAWD, and a record will not need to be entered into the Time Limits page.  Enter an Active Medical Condition record with a Medical Condition Type of Incapacity – Verifiable and at Least 30 Day for the following reasons:
