In October 2019 staff were informed of a new policy for a person ineligible for Food Assistance for certain crimes and verified out of compliance with their sentencing. See the October 2019 Implementation Memo for more information on using Negative Action to deny or discontinue a household of 1.
An example and KEES instructions are below for a more than one-person household where a person that has been convicted of a certain crime and verified not complying with the terms or his/her sentence. Only the person that is out of compliance is ineligible for Food Assistance. Please send any questions regarding the implementation of this policy to Janelle Harper, the Food Assistance Program Manager.
Example:
George applies for Food Assistance on November 21, 2019 for himself, his wife, and 2 children. During the interview George reports that 2 years ago he was convicted of sexual assault. He was put on probation for 4 years. George does not know who his probation officer is and not sure if he is in compliance with his probation. Collateral contacts to the county probation office are unsuccessful. Verification is requested. A fax is received from the county probation office 5 days later that George is not in compliance with his probation. George is not eligible for Food Assistance. His wife and 2 children may be eligible if all other eligibility criteria is met.
The non-compliance does not impact TANF and Child Care. For this scenario use the following process.
Complete the Eligibility Non-Compliance Detail page using the following criteria:
Name: Applicant or Recipient who was convicted of a crime and is not following the terms of their sentence
Type: Trading FA for Drugs
Reason: 2nd Penalty
Program Type: Food Assistance
Begin Date: First day and month of applicable disqualification month
Override End Date: Leave blank
Comments: Crime Attestation
