A Non-Compliance Type of Generic is used to track and/or discontinue or deny consumers who have a felony drug conviction.
Users should navigate to the Non-Compliance page and click the View button to determine if the consumer has any Non-Compliances for a drug felony.
Because the Non-Compliance Type of Generic is being used, Standard Copy and Paste Text must be used.
If a consumer has reported a felony drug conviction for a first offense and has not completed an approved drug treatment program and passed an approved drug test the user needs to create a high dated (no End Date) “Generic Non-Compliance” record on the Non-Compliance page since the penalty would exist until the consumer completed drug treatment and passes an approved drug test. In the Comments text box enter First Felony and the conviction date. See Non-Financial Data Collection Non-Compliance for more information on completing this page.
If the consumer completes the required drug treatment program and passes the drug test for a first offense the user will End Date the “Generic Non-Compliance” record to end the day prior to the month benefits should begin.
Example: FA benefits to start 11/01/20XX. End Date for Non-Compliance should be 10/31/20XX.
If a consumer has reported a Felony Drug conviction for a first offense, a ‘Generic’ non-compliance record must be created using the conviction date as the Begin Date and an End Date of 5 years from the conviction date. (Example: If the Conviction date is discovered at application 12/15/2013, then the penalty Begin Date is 12/01/2013 and the penalty End Date is 11/30/2018). In the Comments text box enter First Felony and the conviction date.
If the consumer is reporting a second drug felony, the user should create a “Generic Non-Compliance ” record on the Non-Compliance page. This Non-Compliance record should be high dated (no End Date) since the penalty is a lifetime ban of TANF or Food Assistance. In the Comments text box enter Second Felony and the conviction date. When a consumer has a felony drug conviction, a Non-Compliance record must be created in KEES. See KEESM 2183 and 2184 for more information on applicable felony drug convictions.
Purple Team:
Complete the Eligibility Non-Compliance Detail page using the following criteria:
Name: Applicant or Recipient with the felony drug conviction
Program: TANF and/or Food Assistance
Type: Generic
Reason: Generic
Begin Date: First day and month of applicable disqualification month
Override End Date: Leave blank or enter date according to policy
Comments: Indicate a first or second felony and conviction date
NOTE for Food Assistance: Append the NOA and use the DCF Standard Text Copy and Paste text for a Food Assistance Discontinuance, Denial, or Change due to a Felony Drug Conviction.
TANF and Food Assistance disqualifications are captured in KEES through the Eligibility Non-Compliance Detail page.
When a disqualification ends, end date the Non-Compliance record and re-run EDBC. See KEESM 2183 and 2184 for more information about regaining eligibility.
Policy should be taken into consideration prior to multi-selecting programs on the Eligibility Non-Compliance Detail page. If needed a record must be entered for each applicable program.
