Verify Lawful Presence (VLP)

 

The Federal HUB partners with the Department of Homeland Security (DHS) to initiate a web service call to verify non-citizenship status. Every individual applying for benefits that declares to be a naturalized citizen, an eligible immigrant, or has acquired citizenship through their parents (derived citizen) must have their lawful presence verified. The VLP process determines the status of the applicant’s lawful presence in the United States. This allows the worker to determine the applicant’s eligibility to receive benefits.

After a record is created on the Non-Citizenship page, the user initiates an interface call to the HUB. See Using the Request Verifications button. The HUB attempts to verify lawful presence through a web service call with DHS. A task is generated after a response is received. The task details depend on whether VLP is determined or if additional information is needed. The details from each verification attempt can be accessed on the Verification List page. One record displays for each verification request.

If VLP is unable to be determined after two attempts, a pre-populated G-845 form is sent to KEES from DHS through a task. Follow the instructions included in the G-845 form and mail the completed document and photocopies of immigration documents to DHS. Upon completion of the G-845 form, update the VLP Documents Mailed Date in the Verification Detail page. Once DHS completes the VLP determination a task is generated.

Accessing VLP Verification Details

  1. Access the case through Person Search or enter the Case Number in the quick search field from Task Navigation and click Go.

  2. Click Eligibility from Global Navigation.

  3. Click Customer Information from Local Navigation.

  4. Click Verifications from Task Navigation. The Verification List page displays.

  5. Click the INS Document hyperlink. The Verification Detail page displays.

  6. Click the View History button. The INS Document Verification Request List page displays.

  7. Click the Submitted Date hyperlink. The INS Document Verification Request Detail page displays.

  8. Use the information from DHS to complete the Non-Citizenship record.
